Manitoba courts rarely award sole custody to only one parent. Court decisions regarding child custody must meet the best interests of the child, and in Canada, there is a presumption that the child must have frequent and substantial contact with both parents.
If divorcing spouses manage to agree on how to allocate parental time, rights, and liabilities reasonably, the court is most likely to approve this arrangement.
Otherwise, the court shall decide child custody in a divorce based on several factors, including the physical and mental condition of each party, the age and development of the child, parent-child relationships, and more.
